State Route 37 in Perry County was shut down for more than an hour Wednesday night as crews investigated a fatal accident.

According to the Lancaster Post of the State Highway Patrol, the one-car accident happened shortly after 4:30 on State Route 37 west of Adcock Road.

Troopers say 44-year-old James Mitchell of Groveport was driving a Cavalier westbound when he drove off the right side of the roadway, struck a tree and came to rest in a creek. Mitchell was ejected from the vehicle and pronounced dead at the scene.

His passenger 42-year-old Sean Penson of Junction City was taken by Med Flight to the Ohio State University Medical Center with critical injuries.

Troopers say both men were not wearing their seatbelts. The crash is under investigation
