Judge Rules in Muskingum Twp. Trustees Lawsuit

A judge has reached a decision in a lawsuit filed against two Muskingum Township Trustees.

According to Attorney Brent Stubbins, visiting Judge James Luse of Fairfield County ruled in favor of Trustees Steven Fusner and Jerry Miller.

Stubbins said Former Muskingum Township Firemen John Benson and Troy Lowe filed a lawsuit asking for the removal of Fusner and Miller after the fire department was disbanded in 2010. The firemen claimed Fusner and Miller neglected to perform their official duties, including a failure to make public records available and the improper purchase of a fire truck in 2008, among other issues.

The case was heard in Muskingum County Common Pleas Court on October 7th. Judge Luse determined Thursday that the petitioners failed to establish evidence needed for the allegations.

We attempted to contact one of the petitioners John Benson but he was unable to be reached for comment.
