Prosecution Rests, Daniel Begins His Defense Friday Morning

Timothy Daniel, the White Cottage man representing himself during his trial for fatally shooting 61-year-old Charles Hooper in the South Zanesville Burger King last October, became increasingly frustrated while questioning witnesses, often needing help from his court-appointed attorney, Jerry McHenry.

The first witness of the day was Jamie Jarrett, the man who drove Daniel to Burger King and left with him following the shooting. Jarrett testified he heard a "pop" while waiting for Daniel to return from inside the fast food restaurant.

Muskingum County Prosecutor Mike Haddox asked, "Did he say anything when he got in the vehicle?" Jarrett explained, "He said, 'go go go go go,'" adding, "I didn't ask him about it, he just said don't worry, he said I didn't shoot her, I just fired a shot in the air."

When news of a fatal shooting at the South Zanesville Burger King came over the radio, Jarrett testified he heard Daniel say, "I aimed too high." While cross-examining his former roommate, Daniel claimed there were inconsistencies with Jarrett's original statement and the testimony he gave Thursday.

"It was right after we heard it on the radio," Jarrett said "You may have said, 'I didn't mean to kill him, I aimed too high.' Something like that. But you did say I aimed too high." While staring at Haddox, Daniel also questioned Jarrett if he had been coached.

Numerous other witnesses took the stand including forensic scientists from the Ohio Bureau of Criminal Investigation, both the Licking and Muskingum County Coroner's, State Trooper Bruce MacLaine, and detectives Brady Hittle and Todd Mahle of the Muskingum County Sheriff's Office. Daniel is charged with aggravated murder, felonious assault, carrying a concealed weapon, and improper handling of a firearm. If convicted, he could face life in prison.
