Muskingum County Sheriff Matt Lutz said an investigation is underway after a toddler falls out of a second story window.

It happened around 8pm Tuesday night. A three year-old male fell out of an apartment window at 2926 Vista View Drive. Sheriff Lutz said the child fell nearly 11 feet before landing on concrete. He was transported to Good Samaritan Hospital with only minor injuries.

"Your first instinct is to say that if a 3 year-old child fell out of a window on the second floor there is some type of negligence on how that three year old was alone, got the window open and fell out of the house," said Lutz.

Currently Muskingum County Sheriff’s Deputies and investigators from Children Services are questioning the family. Lutz said upon completion the case will be presented to Muskingum County Prosecutor Mike Haddox for review.

"We just had the case where the 2 children we lost in the river, and we’ve had children come across weapons in homes before, where people were negligent and left weapons out," said Lutz. "So you know, there are all kinds of things. Kids are mischievous sometimes and ornery and get into a lot of different things."

The families name is not yet being released. Lutz said the family could face misdemeanor or felony charges for child endangerment and negligence.
