Klein Retrial Underway

The trial of Richard Klein began Tuesday morning in Muskingum Common Pleas court.

In a morning session a jury of 5 men and 7 women were seated in the case. Two alternate jurors were also chosen.  Judge Mark Fleegle explained to the jury how the court case would be conducted, warning them not to discuss the case with anyone.

Richard Klein is charged with two counts of endangering children and two counts of involuntary manslaughter in the deaths of 3-year-old Ayden Cecil and 2-year-old Anthony Tullius. The pair are believed to have accidently drowned in the Muskingum River while camping near Ellis Dam in June of 2011.

This is a retrial for Klein who was convicted of the case in February of 2012 along with his wife Kasey. They were both sentenced to 12 years in prison.

Attorney’s for Richard Klein appealed the conviction arguing the trial was unfair and that the pair should have been tried separately.

Tuesday afternoon the court expects to hear opening statements from Prosecutor Bob Smith and defense attorney Sam Shamansky  in the case.
