Doctors are backing the creation of screening panels to weed out frivolous malpractice lawsuits in Ohio. A bill introduced by representative Jean Schmidt, a Cincinnati republican, would allow a doctor being sued to request a panel to review the accusation. The panel could recommend the lawsuit continue or be dropped. The panel’s findings could not stop a lawyer from taking a case to trial but the results could be used as evidence. Doctor say the panels are needed to stop frivolous lawsuits which can cost thousands of dollars even if the lawsuit is dismissed. Trial attorneys say the practice would place another obstacle between an injured patient and a jury.
