He was convicted once in the death of his daughter…he appealed the decision…a new trial resulted in a hung jury.

Now Eric Patterson is facing a third trial. Patterson’s attorney Dennis Belli argued that a third trial would not fall within the time frame set by an appeals court, therefore Patterson should be granted an unconditional release.

On Friday, January 13th, U.S. District Court Judge Edmund Sargus denied that motion. HE also ruled that new evidence may be introduced in the third trial.

Assistant Muskingum County Prosecutor Jim Workman says a new trial date has not yet been set.
