A White Cottage man convicted in the shooting death of a man at the Burger King in South Zanesville in 2013 is re-sentenced today. 35-year-old Timothy Daniel appeared before Muskingum County Common Pleas Judge Mark Fleegle after the Ohio Supreme Court announced that it would not hear an appeal of a 5th District Court ruling that reduced Daniel’s life sentence with no parole. The Ohio Supreme Court has announced that it does not plan to review the decision of the 5th District court of Appeals Court reducing the conviction and sentence Timothy Daniel of White Cottage. The man convicted of a fatal shooting at the Burger King in South Zanesville learned his fate Monday. 

34-year-old Timothy Daniel of White Cottage was sentenced to life in prison without parole on an aggravated murder charge in the shooting death of 61-year-old Charles Hooper of Zanesville. 

Daniel has already appealed his conviction.

The man charged in a fatal shooting at Burger King in South Zanesville last October has been found guilty on all counts.  34-year-old Timothy Daniel was charged with aggravated murder with a gun specification, felonious assault, carrying a concealed weapon and improper handling of a firearm in the death of 61-year-old Charles Hooper.  Daniel faces life in prison which Prosecutor Mike Haddox says he is going to recommend.
