Ohio's Fifth District Court of Appeals has made a ruling in the case involving a Zanesville man convicted of a fatal shooting at the South Zanesville Burger King.

According to court documents, the Judges ruled on Thursday that an aggravated murder charge against Timothy Daniel was not warranted and reduced the charge to murder .

A Muskingum County jury found Timothy Daniel guilty of aggravated murder for fatally shooting Charles Hooper last October in the South Zanesville Burger King. But before the jury retired to deliberate, Daniel's plan to make his self-defense tactic credible, and discredit his then-girlfriend Darlene Bender's testimony, backfired on him.
