Tri Valley School Board Member Files in Court

An effort to force a Tri Valley school board member to resign over allegations of sexual misconduct has resulted in a lawsuit filed in United States District Court for the Southern District of Ohio. Attorney David Ball says Board Member Jason Schaumleffel filed in federal court against Muskingum University, Mark Neal, Macey Zambori and Mackenzie Dickerson.
The complaint claims that among other things the defendants discriminated against Schaumleffel on the basis of his male gender, Ms Zambori made false allegations of sexual misconduct against Schaumleffel after they engaged in sexual activity in February of 2016. It also claims that Ms. Dickerson made false allegations of sexual misconduct against the plaintiff after they engaged in consensual sexual activity in late November and early December of 2016. And Muskingum University conducted a biased and unfair investigation into the allegation of Ms. Zambori and Ms. Dickerson, and as a result, Muskingum improperly and unlawfully expelled Schaumleffel. The plaintiff is requesting a jury trial.
Tri Valley Superintendent Mark Neal, who noted he was being named in the suit as an individual, not as superintendent, says he was directed by the school board president to conduct an investigation and the details he reported to the board are being confirmed in the lawsuit and that he is baffled by the legal action.

Muskingum University issued a statement Wednesday:  We are aware of the complaint filed. Our top priority has always been and will always be the safety and wellbeing of all of our students. In any situation involving students, Muskingum follows very carefully designed procedures in accordance with rules established by the U.S. Department of Education. Due to the nature of pending litigation and restrictions imposed on education records by federal law, no further information is available.
