CLEVELAND (AP) — A 15-year-old boy accused of driving a stolen car that struck and killed a 13-year-old pedestrian during a police pursuit last year will be tried as an adult.

Citing court records, Cleveland.com reported Monday that a judge approved moving D’Shaun McNear’s case last Wednesday. He’s charged with murder, aggravated robbery and other offenses and remained jailed Monday in lieu of $150,000 bond.

McNear and another 15-year-old boy carjacked a woman at gunpoint in a store parking lot in Cleveland on Dec. 20, authorities have said. An off-duty Cleveland police officer witnessed the carjacking and followed the teens onto a highway before a police supervisor took up the pursuit.

The stolen vehicle eventually struck Tamia Chappman, who was on a sidewalk and walking to the library after school to meet her siblings.

The other teen who authorities said was with McNear pleaded guilty in April to involuntary manslaughter and was sentenced to a four-year term at a juvenile detention center. His name has bot been released.

Tamia’s mother filed a wrongful-death lawsuit in May against the Cleveland police department and 22 officers involved in the pursuit. The suit claims officers violated departmental policy and state law by not ending the high-speed pursuit.
