Ohio Supreme Court Won’t Review Appeals Court Decision

The Ohio Supreme Court has announced that it does not plan to review the decision of the 5th District court of Appeals Court reducing the conviction and sentence Timothy Daniel of White Cottage. The Muskingum County Prosecutor’s Office filed an appeal after the District Court’s opinion was made public. Daniel was convicted by a Muskingum County Jury for the October 2013 execution of Charles Hooper of Zanesville at the Burger King on Maysville Avenue. Hooper had intervened in Daniel’s heated threatening argument with his then girlfriend. Daniel rebuffed Hooper and when confronted again decided to kill Hooper with his gun. The jury convicted Daniel who was sentenced to life in prison without parole. The Appeals Court disagreed with the jury and reduced Daniel’s conviction from Aggravated Murder to Murder and reduced the sentence to 18 years to life and the Ohio Supreme Court says it will not review that decision.
