Judge denies Zanesville doctors motions

A judge has issued a ruling in a case that involves two Zanesville physicians.
Dr. James Gasparine and Dr. Samuel Finck are each facing misdemeanor failure to report charges and have pleaded not guilty.
The charges are in connection to treating the gunshot wound of Josh Daniels after he attempted to commit an armed robbery in 2012.
The defendants filed a motion to dismiss in Zanesville Municipal Court. Visiting Judge Linton Lewis this week denied the motion.
At issue was the statute of limitations which on a misdemeanor is two years and it had been five years since the alleged incident.
Zanesville’s Law Director David Tarbert maintains the statute of limitations does not begin when the crime occurs but when law enforcement learns of the crime which was in October of 2016.
The court is now proceeding toward a jury trial in the case.
