Underwood Appeal Denied by 5th District Court

The fifth District Court of Appeals in Canton has denied the appeal of a Zanesville man convicted in the death of area resident Brandy Daniels. Sirius Underwood in 2017 pleaded guilty in Muskingum County Common Pleas Court to multiple felonies including aggravated murder, aggravated robbery and aggravated burglary in the 2014 death of Daniels. In his appeal Underwood claimed the trial court rendered his plea involuntary and violated his constitutional rights by ignoring the joint recommendation of sentence and imposing a sentence that exceeded the agreed upon sentencing recommendation. The Appeals Court disagreed. Underwood was sentenced last March to life in prison without parole for 38 years.
