Judge Decides Motions in Schaumleffel Lawsuit

The lawsuit initiated by a Muskingum County man against Muskingum University, Tri-Valley Superintendent Mark Neal and two women who accused him of sexual misconduct is making its way through United States District Court of Southern Ohio, in the Eastern Division. Judge George Smith has granted several motions to dismiss the lawsuit filed by Jason Schaumleffel. The case was filed last May with Schaumleffel claiming it violated his Title IX right by discriminating against him because of his male gender. The suit also claims the two women made false allegations after he engaged in consensual sexual activity with one of them in February of 2016 and December of 2016. Lawyers for the women and Muskingum University filed to dismiss the complaint. Judge Smith granted and denied parts of each motion. Judge Smith dismissed claims made by Schaumleffel for negligent infliction of emotional distress by the two women but the other claims against the women are pending. Judge Smith also dismissed Schaumleffel’s claims against the University other than breach of contract, erroneous outcome in violation of Title IX and four other issues. Schaumleffel, a Tri-Valley school board member, is not allowed on the Tri-Valley campus but is allowed to attend board meetings.
