Appeals Court Makes Ruling in Daniel Case

Ohio’s Fifth District Court of Appeals has made a ruling in the case involving a Zanesville man convicted of a fatal shooting at the South Zanesville Burger King.

According to court documents, the Judges ruled on Thursday that an aggravated murder charge against Timothy Daniel was not warranted and reduced the charge to murder .

Back in February, Daniel was orginally sentenced to life in prison without the chance of parole in the shooting death of 60-year- old Charles Hooper.

Muskingum County  Assistant Prosecutor Ron Welch says the murder charge carries a mandatory sentence of 15 years to life with the chance for parole.

Welch says the Prosecutor’s Office  will now review the Court’s ruling and decide in the next couple of weeks whether or not they want to appeal the decision.
