Dutiel Rape Charge Dismissed By Prosecutor

 The rape charge against a Perry County businessman Don Dutiel has been dismissed.

Prosecutor Joe Flautt says he made that move because New Lexington Police have yet to submit evidence to a crime lab and he did not want to put the victim through a cross examination during a preliminary hearing.

Last week the 61-year-old Dutiel was charged with rape by New Lexington Police. No other details were released.

Sergeant Rick Cline says Dutiel was arrested last week and transported to the Southeastern Ohio Regional Jail.

Prosecutor Flautt says if he had been consulted by investigators Dutiel would not have been arrested.

Flautt says the case could still be presented to a Grand Jury in the future.
